DailyCumulus Terms of Service

Effective: October 20, 2026 (previous version: September 29, 2026)

These Terms are available in English and Korean. If you live outside Korea, the English version controls. If you live in Korea, the Korean version controls.

1. About these terms

These Terms of Service ("Terms") are an agreement between you and Mauve Labs ("we," "us") about your use of DailyCumulus (formerly Maeumlog), our mood journal app, and related services (the "Service").

2. Definitions

3. Changes to these terms

  1. We post these Terms in the app (Settings > Terms of Service) and on this page.
  2. We may update these Terms as permitted by law. We'll announce changes in the app at least 7 days before they take effect, including what's changing, why, and when. For changes that are unfavorable to you or otherwise significant, we'll give at least 30 days' notice and notify members individually in the app or by email. For users who aren't signed in, and whom we can't contact, the in-app notice serves as individual notice.
  3. If our notice clearly says that you'll be treated as accepting the changes unless you object before they take effect, and you don't object, you'll be treated as having accepted them. We may also ask you to accept updated Terms directly in the app.
  4. If you don't agree with the changes, you can delete your account at no charge. Refunds for Premium are handled under Section 11. Entries stored on your device aren't affected.

4. Accounts and minimum age

  1. You can use the free features without an account by agreeing to these Terms and installing the app.
  2. A membership is formed when you agree to these Terms and our Privacy Policy, sign in with a supported account, and we accept.
  3. You must be at least 14 years old to create an account. You confirm your age when you sign in. If we learn that a member is under 14, we'll close the account and promptly delete their personal information. If you're under the age of majority where you live, you should review these Terms with a parent or guardian.
  4. We may refuse or later cancel an account created in violation of these Terms, such as with someone else's account or false information.

  1. Core features such as mood entries, stats, search, and reminders are free and don't require an account.
  2. Premium is purchased through in-app purchase. Sign-in options may vary by operating system (Sign in with Apple is available on iOS).

6. Not a medical or counseling service

  1. DailyCumulus is a personal journal that helps you record and reflect on your feelings. Stats, insights, and messages in the app are simple summaries of what you entered. They are not medical or psychological advice, diagnosis, treatment, or counseling, and they don't replace them.
  2. Talk to a doctor or other qualified professional about your health. If you're in crisis or thinking about harming yourself, get help right away: in the US or Canada, call or text 988; in Australia, call Lifeline at 13 11 14; in New Zealand, call or text 1737; in Singapore, call SOS at 1767. In an emergency, call your local emergency number (such as 911, 000, 111, or 995). DailyCumulus is not an emergency or crisis service, and we don't monitor entries or respond to them.
  3. We don't read or analyze your entries to judge your condition or intervene. You're responsible for the content of your entries.

7. Changes to the Service

  1. We may change the Service for operational or technical reasons. We'll announce changes in advance as described in Section 3.
  2. For changes that reduce Premium features or are otherwise unfavorable to paying users, we'll give at least 30 days' notice. For subscription time you've already paid for, we'll keep providing the previous features or, if we can't, refund the remaining time through the Store where possible (for App Store purchases, by supporting a refund request to Apple).
  3. We'll keep cloud backup and sync, the core features of lifetime access, available for the Service Period.

8. Service interruptions and shutdown

  1. We may temporarily suspend the Service for maintenance, outages, network failures, natural disasters, or similar reasons. We'll let you know in advance when we can, or afterward when we can't.
  2. If we decide to shut down the Service entirely, we'll announce it in the app and notify members individually at least 30 days before the shutdown date. If the shutdown is caused by something outside our control, such as a service provider discontinuing its service, we'll let you know as soon as we can.
  3. Before a shutdown, we'll make reasonable efforts to let members retrieve the entries stored on our servers. Entries stored on your device stay on your device.
  4. If we shut down the Service, we'll refund the unused portion of any paid subscription period through the Store where possible (for App Store purchases, by supporting a refund request to Apple). For lifetime access, we use five years from the purchase date as the reference period: if we shut down within five years of your purchase, we'll refund purchase price × (5 years − time from purchase to shutdown) ÷ 5 years. No refund is due if the shutdown happens more than five years after purchase.

9. Your entries

  1. Your entries belong to you. We process them only to store, sync, and show them to you. We don't use them for advertising, analytics, or AI training, and we don't give them to third parties.
  2. On the free plan, entries are stored only on your device, and we can't access or keep them. We can't recover entries lost because a device is lost, broken, or reset, the app is deleted, or the operating system fails, and we aren't responsible for that loss unless it's caused by our intentional misconduct or gross negligence.
  3. Entries dated within a period when you had Premium (including the day you paid) are synced to our servers, and you can restore them on a new device by signing in to the same account. Other entries stay only on your device, even after you upgrade.
  4. When Premium ends (a subscription expires, is refunded, or otherwise ends), we keep your server entries for one year from the end date and then permanently delete them. If you start Premium again within that year, they won't be deleted. This doesn't apply to lifetime access, which doesn't end. You can see the scheduled deletion date in the app.
  5. That deletion applies only to our server copy. Entries on your device aren't deleted.
  6. We take reasonable measures to protect the entries stored on our servers from loss.

10. Payments, subscriptions, and auto-renewal

  1. Premium is sold only through in-app purchase. Payment methods, receipts, and purchase history are governed by the Store's policies. The price is the amount shown at checkout. Applicable taxes are calculated by the Store.
  2. Subscriptions renew automatically for the same period until you cancel. You can cancel in your Store's subscription settings (iOS: Settings > your name > Subscriptions; Android: Google Play > Payments & subscriptions). To avoid the next charge, cancel at least 24 hours before the renewal date. After you cancel, you keep Premium until the end of the period you've paid for. For yearly subscriptions, we'll also remind you in the app 15 to 45 days before each renewal, with the price and how to cancel.
  3. Deleting the app, signing out, or deleting your account doesn't cancel a subscription. We remind you of this before you delete your account. You need to cancel in the Store.
  4. If we raise a subscription price or start charging for a feature that was free, we'll tell you at least 30 days in advance, including the date, the old and new prices, how you'll be charged, and how to cancel and what happens if you do. Depending on the Store's rules, you may be asked to accept the new price (and if you don't, your subscription ends at the next renewal date), or the new price may apply at renewal unless you cancel.
  5. Lifetime access belongs to the member account that bought it and can't be transferred to another account (Store family sharing, where it applies, follows the Store's rules). If you have an active subscription, you'll need to cancel it before buying lifetime access. The app tells you before you buy.
  6. Store purchases belong to your store account (Apple ID or Google account), so each purchase can be linked to only one DailyCumulus account. A purchase already linked to one account can't be linked to another. However, if the linked account has been permanently deleted under Section 15, you can link the purchase to a new account created with the same store account by using Restore purchase.

11. Cancellations and refunds

This section applies if you live outside Korea. If you live in Korea, the refund rules in the Korean version of these Terms (Article 11) apply instead.

  1. Refunds follow the Store's refund policy. Purchases are processed by Apple or Google, and refund requests are handled under their policies: for the App Store, at reportaproblem.apple.com or from within the app; for Google Play, through Google Play or by contacting us. Under our agreement with Apple, we can't issue App Store refunds ourselves.
  2. Cancelling a subscription stops future renewals. You keep Premium until the end of the period you've already paid for. We don't give refunds or credits for partial subscription periods or unused time, except where required by law.
  3. Lifetime access is a one-time purchase of digital content that starts as soon as payment is complete. Once you've started using Premium, lifetime access isn't refundable, except where required by law or under Section 11.4.
  4. Regardless of the above, if you were charged because of our error (such as a duplicate charge), the Service wasn't provided as described, or you couldn't use Premium because of our fault, contact us and we'll make it right, including a full refund through the Store where possible (for App Store purchases, we'll support your refund request to Apple).
  5. If a minor bought Premium without a parent or guardian's consent, the parent or guardian may contact the Store or us to request cancellation.
  6. When a refund is made, including one processed by the Store, the Premium access from that purchase is removed.
  7. Nothing in this section limits any refund or cancellation right you have under the consumer laws of the place where you live (see Section 26).
  8. Send refund and billing questions to mauvelabs@mauvelabsinc.com.

12. Your responsibilities

You agree not to:

You're responsible for keeping your sign-in account and your device lock (passcode, biometrics, etc.) secure. We aren't responsible for losses caused by your failure to do so, except where we're at fault.

13. Suspension

  1. If you violate Section 12, we may suspend your use of the Service or close your account after giving you notice (or, in urgent cases, promptly afterward).
  2. If Premium access was obtained fraudulently, we may remove it.
  3. You can dispute a suspension by contacting us (Section 25). If we find your objection justified, we'll restore access right away.

14. Our responsibilities

  1. We comply with the law and these Terms and work to provide the Service reliably.
  2. We handle your personal information as described in our Privacy Policy.
  3. We handle your feedback and complaints promptly. If something will take time, we'll tell you why and when to expect a response.

15. Deleting your account

  1. You can delete your account at any time in the app (Profile > Settings > Delete account). If you can't use the app, you can ask us by email or through our account deletion page. To protect you, we may ask you to confirm with biometrics (Face ID or fingerprint) or your device passcode before deleting.
  2. When you delete your account, you're signed out right away and your entries and photos for that account are deleted from the device. If you signed in with Apple, we also ask Apple to revoke the sign-in connection.
  3. If you sign back in with the same account within 30 days, the deletion is canceled and you keep your server entries and any active Premium. Entries that were only on your device (not backed up with Premium) can't be recovered. After 30 days, your account information (email, name, and sign-in connection), the entries, photos, and profile photo stored on our servers, and your settings are permanently deleted and can't be recovered. You can also ask us to delete everything immediately instead of waiting 30 days.
  4. Payment and transaction records are disconnected from your account and kept separately for the period required by law (5 years), then deleted. If you sign up again with the same store account after your old account has been permanently deleted, you can relink valid purchases, such as lifetime access, with Restore purchase (Section 10.6).
  5. Deleting your account doesn't cancel your subscription (Section 10.3).

16. Disclaimers

  1. We provide the Service "as is" and "as available." To the fullest extent permitted by law, we don't make any warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, and we don't promise that the Service will be uninterrupted, error-free, or that entries will never be lost.
  2. Stats, insights, and messages in the app are based only on what you enter. We don't guarantee their accuracy or that they're suitable for any health-related decision (see Section 6).
  3. Some places don't allow these disclaimers. Nothing in these Terms excludes, restricts, or modifies any right or remedy you have under laws that can't be excluded, such as the consumer guarantees under the Australian Consumer Law or New Zealand's Consumer Guarantees Act.

17. Limitation of liability

  1. We aren't liable if we can't provide the Service because of events beyond our reasonable control, such as natural disasters, war, power outages, or network failures, or because of outages at third parties such as the Stores, sign-in providers, carriers, or device and operating system makers.
  2. We aren't liable for losses caused by your own fault, such as not securing your device, sharing your account information, or violating these Terms.
  3. To the fullest extent permitted by law, we aren't liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.
  4. To the fullest extent permitted by law, our total liability for all claims relating to the Service is limited to the greater of (a) the amount you paid us for the Service in the 12 months before the claim arose, or (b) US$50.
  5. This section doesn't limit liability for death or personal injury caused by our negligence, for our fraud, intentional misconduct, or gross negligence, or any liability that can't be limited by law. Where the law allows us to limit our liability for a failure to meet a non-excludable consumer guarantee, our liability is limited, at our option, to supplying the Service again or paying the cost of having it supplied again.

18. Indemnity

If you use the Service in violation of these Terms or the law and that causes a third party to bring a claim against us, you agree to cover the reasonable losses and costs (including reasonable legal fees) we incur because of it, to the extent permitted by law. This doesn't apply to claims caused by our own fault.

19. Ending these Terms

  1. You can stop using the Service at any time and delete your account as described in Section 15.
  2. We may suspend or end your access as described in Section 13, or if we shut down the Service as described in Section 8.
  3. Sections that by their nature should survive (such as 9.1, 11, 16, 17, 18, 20, and 21) continue to apply after these Terms end.

20. Governing law and where to bring claims

  1. These Terms are governed by the laws of the Republic of Korea. This doesn't take away any protection you have under the mandatory consumer laws of the country or state where you live.
  2. If you live outside Korea, you may bring a claim in the courts where you live, including a small claims court if your claim qualifies. If you live in Korea, lawsuits are handled as provided in Article 36 of Korea's Act on the Consumer Protection in Electronic Commerce (the district court for your domicile or, if you have none, your place of residence).

21. Resolving disputes

If a dispute comes up, please contact us first at mauvelabs@mauvelabsinc.com. We'll try in good faith to resolve it within 30 days. You can also contact the consumer protection agency where you live. If you live in Korea, you can apply for mediation to the Korea Consumer Agency or the Content Dispute Resolution Committee.

22. Additional terms for App Store users

  1. If you downloaded the iOS app from the App Store, your use of the app is also governed by Apple's Licensed Application End User License Agreement (Standard EULA). These Terms add to the Standard EULA; they don't replace it.
  2. These Terms are between you and us, not Apple. We, not Apple, are responsible for the app and its content, maintenance and support, warranties, and product claims.

23. Export controls and sanctions

You confirm that you're not located in a country subject to a US government embargo or designated as a "terrorist supporting" country, and that you're not on any US government list of prohibited or restricted parties. You agree to follow all export control and sanctions laws that apply to your use of the Service.

24. General

  1. If any part of these Terms is found invalid or unenforceable, the rest remains in effect.
  2. If we don't enforce a part of these Terms right away, that doesn't mean we've given up the right to enforce it later.
  3. You can't transfer your rights under these Terms to anyone else. We may transfer ours as part of a merger, acquisition, or sale of the Service, and we'll let you know if we do; your rights under these Terms won't be reduced as a result.
  4. Anything not covered by these Terms is governed by applicable law and general commercial practice.

26. Additional terms by region

These terms apply to you in addition to the rest of these Terms. If they conflict, the terms in this section apply.

United States. If you live in California, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210. Nothing in these Terms waives any right you have under the laws of your state that can't be waived by contract.

Australia. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to choose a refund or compensation for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract. Sections 16 and 17 apply only to the extent permitted by the Australian Consumer Law.

New Zealand. Nothing in these Terms limits any rights you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, except where you use the Service for business purposes, in which case the Consumer Guarantees Act doesn't apply.

Singapore. Nothing in these Terms limits any rights you have under the Consumer Protection (Fair Trading) Act 2003 or other laws of Singapore that can't be excluded by contract.

Korea. If you live in Korea, the Korean version of these Terms applies to you.

Effective date

October 2026 update. Section 5 changes on October 20, 2026: Free now includes 3 entries a day and all stats (mood and activity insights included), and the table adds how long past monthly flowers and mood colors are kept. These changes only add to what Free includes.

These Terms take effect on September 29, 2026. For members who signed up before that date, they apply from the time you accept them in the app; until then, the previous Terms apply. For subscription periods paid before that date and for lifetime access bought before that date, if the previous Terms are more favorable to you on refunds, the previous Terms apply.
